The Firearms Control Act (No. 60 of 2000) is the primary legislation governing the possession, use, and disposal of firearms in South Africa. Every licensed firearm owner should have a working understanding of the Act, because ignorance of its provisions is not a defence in court.

Licence Types

The Act provides for several categories of firearm licence, each with its own requirements and restrictions:

  • Section 13: Licence for self-defence. Limited to one firearm per person for this purpose.
  • Section 15: Licence for occasional sport shooting or hunting.
  • Section 16: Licence for dedicated sport shooting or hunting. Requires membership of an accredited association.
  • Section 17: Licence for professional hunting. Available to registered professional hunters.
  • Section 20: Licence for business purposes. For security companies, arms dealers, and similar businesses.

Key Obligations

Licensed firearm owners must comply with several ongoing obligations:

  • Safe storage: All firearms must be stored in an approved safe that meets SABS standards. The safe must be fixed to the structure of the building.
  • Competency certificate: Before applying for a licence, you must hold a valid competency certificate.
  • Licence renewal: Licences must be renewed before their expiry date. Failure to renew on time results in the licence lapsing.
  • Reporting: Loss, theft, or destruction of a firearm must be reported to the police within 24 hours.
  • Transport: When transporting a firearm, it must be kept in a locked container that is not visible from outside the vehicle.

Penalties for Non-Compliance

The Firearms Control Act prescribes severe penalties for contraventions. Unlawful possession of a firearm carries a minimum sentence of 15 years imprisonment. Other offences carry penalties ranging from fines to imprisonment.
